These Terms of Use ("Terms," "Agreement") govern your access to and use of the website located at https://refineemail.com (the "Site") and any associated email deliverability tools, domain security monitoring, DMARC/DKIM/SPF analysis, BIMI hosting, reporting dashboards, and related services (collectively, the "Services") provided by Iridge Technologies d/b/a RefineEmail ("RefineEmail," "Iridge," "we," "us," or "our").

By accessing or using our Site or Services, registering an account, or purchasing a subscription, you ("User," "Client," or "you") agree to be bound by these Terms. If you are entering into this Agreement on behalf of a company, educational institution, or other legal entity, you represent that you have the authority to bind such entity to these Terms.

1. Description of Services

RefineEmail provides SaaS and consulting solutions designed to optimize email deliverability, strengthen domain security, and monitor email authentication protocols, including but not limited to:

  • DMARC & Aggregate Reporting: Ingestion, processing, and visualization of DMARC failure and aggregate reports (RUA/RUF).
  • Email Authentication Checks: Analysis of SPF records, DKIM signatures, DMARC configurations, and TLS enforcement.
  • Brand Protection & BIMI: Configuration monitoring and hosting of Brand Indicators for Message Identification (BIMI) assets.
  • Domain & IP Threat Monitoring: Geo-location tracking and alerts regarding domain spoofing or unauthorized sending sources.

We reserve the right to modify, enhance, or discontinue any feature or aspect of the Services at any time, with or without prior notice.

2. Account Registration and Domain Authorization

A. Account Responsibility

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are fully responsible for all activities that occur under your account.

B. Domain Ownership & Authorization

By adding a domain to the RefineEmail platform for monitoring or analysis, you explicitly warrant and represent that you are the lawful owner of the domain, or an authorized administrator with explicit permission to configure DNS records and analyze email traffic data for that domain. Unauthorized monitoring or spoofing verification of third-party domains is strictly prohibited.

3. Subscriptions, Fees, and Payments

A. Subscription Plans & Invoicing

Services are offered under trial, or paid subscription tiers (e.g., Monthly or Annual plans). Subscriptions are billed in advance on a recurring basis by Iridge Technologies. Payment obligations are non-refundable once processed except as required by law or specified in a separate enterprise agreement.

B. Billing & Payment Terms

  • Payments must be made via an authorized credit card or approved payment method.
  • Invoices are due according to the payment terms specified at checkout or on the invoice (e.g., Net 15).
  • Unpaid balances or failure to process recurring charges may result in temporary suspension or termination of access to reports and monitoring tools.

C. Tier Limits & Overages

Trial or Starter plans may be subject to strict caps (such as limits on monitored domains, monthly processed email volume, or historical report retention periods). Exceeding tier allowances may require an upgrade to a higher subscription tier.

4. Acceptable Use and Restrictions

You agree not to use the Site or Services to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Interfere with, bypass, or compromise the security, integrity, or performance of the Site, platform infrastructure, or DNS lookup services.
  • Attempt to reverse engineer, decompile, or extract the source code of any proprietary tools, scripts, or algorithms used by RefineEmail.
  • Probe, scan, or test the vulnerability of any system or network outside the scope of your authorized email domains.
  • Misuse or upload malicious, deceptive, or infringing content (including unauthorized SVG logos submitted for BIMI hosting).

5. Data Privacy and Security

Our collection, use, and processing of personal data and email reporting metadata are governed by our Privacy Policy.

By using the Services, you acknowledge that RefineEmail ingests public DNS records and automated DMARC XML reports generated by third-party mail servers (e.g., Google, Microsoft, Yahoo). RefineEmail processes this data solely to provide deliverability insights, detect threat vectors, and generate security reports.

6. Intellectual Property Rights

  • RefineEmail Ownership: All software, algorithms, user interfaces, branding, domain audit tools, logos, and website content are the exclusive property of Iridge Technologies and its licensors. Nothing in these Terms grants you ownership of any RefineEmail intellectual property.
  • Client Content & Logos: You retain all ownership rights to your business logos, domain marks, and submitted brand assets (e.g., BIMI SVGs). You grant RefineEmail a non-exclusive, world-wide, royalty-free license to host, format, and display your brand assets solely as necessary to perform the BIMI hosting and monitoring services.

7. Third-Party Integrations and Services

The Services may interact with third-party providers, including DNS host providers, domain registrars, payment processors, and analytics platforms. RefineEmail does not guarantee the availability, uptime, or performance of external third-party services, DNS propagation speeds, or third-party email provider algorithms.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

REFINEEMAIL AND IRIDGE TECHNOLOGIES EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT EMAIL DELIVERABILITY WILL BE 100% SUCCESSFUL, THAT DMARC POLICIES WILL PREVENT ALL SPAM OR PHISHING ATTEMPTS, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IRIDGE TECHNOLOGIES, REFINEEMAIL, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR EMAIL DELIVERABILITY FAILURE) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO IRIDGE TECHNOLOGIES / REFINEEMAIL FOR THE SPECIFIC SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Iridge Technologies, RefineEmail, and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of the Services;
  • Your violation of these Terms;
  • Any unauthorized configuration or missing authorization for domains you submit for analysis; or
  • Infringement of any third-party intellectual property or privacy right related to brand logos or data provided by you.

11. Termination

  • By You: You may terminate your account or subscription at any time by reaching out through our contact form or managing your account settings.
  • By Us: We reserve the right to suspend or terminate your account or access to the Services immediately, without notice or liability, if you violate these Terms, fail to pay subscription fees, or engage in activity harmful to our systems or users.
  • Effect of Termination: Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitations of Liability, and Indemnification) shall remain in full force.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts located in Cook County or Lake County, Illinois.

13. Changes to Terms

We may update these Terms from time to time. When updates occur, we will revise the "Last Updated" date at the top of this page. Continued use of the Site or Services following the posting of revised Terms constitutes your acceptance of the changes.
